Case summary
Appeal dismissed. We think that there was evidence on which the Tribunal could come to the decision that they did, namely that Ms. Cumberbatch was employed by the appellant under a contract of employment. We do not think it fatal to that conclusion that she had not actually attended for work. Nor do we think that the commencement of employment is necessarily the same as the first day at work. Although there were irregularities in the hearing, we do not think that they are sufficient to justify setting aside the award, which, looked at in the round, we considered "just and equitable in all the circumstances".
