Case summary
The extension of time was granted. The Court found the length of the delay was not excessive in the circumstances, the reason for the delay was reasonable and excusable and not inordinate, there was no evidence of prejudice peculiar to the Respondent, and on the face of it there was an arguable case for an appeal if the extension was granted. The Court was therefore of the view that this was an appropriate case in which to exercise its unfettered discretion to grant the Applicant an extension of time in which to lodge its appeal.
